Acceptance of Terms

Welcome to uBurg! uBurg offers users a collection of online resources including communications tools, forums, personalized content and various other email and online services subject to the following Terms of Use (TOU). By using any of uBurg’s services you agree and understand to comply with the TOU. In addition, when using a particular uBurg service you are subject to any posted guidelines or rules. You also understand and agree that the service may include advertisements. In case you object to any term or condition of uBurg’s TOU, any rule or guideline or any subsequent modifications in any way your only recourse is to immediately discontinue using uBurg’s Services.

Notice

uBurg may at any time amend, supplement, change or modify the terms of this agreement, and will post a copy of the amended agreement at www.uburg.com. If you do not agree to be bound by (or cannot comply with) the agreement as amended or supplemented, your only remedy is to stop using the service and/or account. You will be deemed to have accepted the agreement as amended if you continue to use the service; all other terms of this agreement will continue in effect. Such modifications shall become effective immediately upon posting. You must review this agreement on a regular basis to keep yourself apprised of any changes.
uBurg does not allow a child under age 13 to register on the web site, as a condition of participation, children under 13 must have a parent or a guardian authorize to participate or register with any uBurg service.

User Conduct

You agree that all information, text, messages, graphics, photographs, graphics and all other materials considered content are the responsibility of the person whom the content originated. uBurg is not responsible for content made available through the service and we cannot guarantee the accuracy, integrity or quality of such content. You agree that using uBurg’s service you may be exposed to information or content that may be offensive, indecent, misleading or otherwise objectionable.
Listed below are some of acts or actions (violations), though not all, you agree not to do while using the service:

•        Harass, 'stalk', threaten, embarrass or cause distress or discomfort upon another uBurg participant, user, or other individual or entity;
•        Upload, post, email, SMS, or otherwise transmit via the service any content that uBurg considers to be unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful, racially, ethnically or otherwise objectionable;
•        Upload, post, email, SMS, or otherwise transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit functionality of any computer software or hardware or telecommunications equipment;
•        Upload, post, email, SMS, or otherwise transmit any content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights ('Rights') of any party;
•        Cause any screen in the service to 'scroll' faster than other users are able to type to it or any action to a similar disruptive effect;
•        Impersonate in the service any person, including but not limited to, a uBurg official, forum leader, guide or host;
•        Disrupt the normal flow of dialogue within the service or otherwise act in a manner that negatively affects other participants;
•        Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted via the service;
•        Collect or store personal data about other users; Intentionally or unintentionally violate any applicable local, state, national or international law, including but not limited to any regulations having the force of law while using or accessing the service or in connection with your use of the service in any manner;
•        Provide or send any content which may be harmful or detrimental to uBurg or its business associates, or which violates any restriction or policy established by uBurg or its business associates;
•        Harm minors in any way;
•        Intentionally or unintentionally violate any applicable local, state, national or international law;
•        interfere with or disrupt the service or servers or networks connected to the service, or disobey any requirements, procedures, policies or regulations of networks connected to the service;
•        Provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act;
•        Post or transmit any unsolicited advertising, promotional materials, or any other forms of solicitation in the service.
You understand and agree that uBurg may not pre-screen all content but shall have the right to pre-screen, refuse or remove any content that is available in uBurg’s service.
You agree and understand that uBurg may access, and disclose your account information and content if required by law. Any unauthorized reproduction, publication, further distribution or public exhibition of the materials provided via the service is prohibited.

Your Registration Obligations

In order to use the service, you must register and provide certain information (e.g., name, country or territory of residence and billing information) to uBurg Corp. ('Registration Data'). You agree that you will use the Service only in the country where you currently reside. You agree to provide current, complete and accurate Registration Data at the time you register and that you will update your Registration Data as necessary to keep it current, complete and accurate in the 'My Account' area of the uBurg Website. uBurg Corp will use your Registration Data in accordance with its Privacy Policy, which you can review at Privacy. Please review this Privacy Policy before you complete the registration process or attempt to use or access the Service.
You agree that you will not allow others to use your member name, password and/or account. You agree to indemnify and hold harmless uBurg., its partners, parents, subsidiaries, agents, affiliates and/or licensors, etc. as applicable, for any improper, unauthorized or illegal uses of your member name, password and/or your account. This includes illegal, unauthorized or improper use by anyone to whom you have given permission to use your member name, password and/or account.

Privacy Policy

uBurg does not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services you've requested, and when we have your permission.
uBurg uses information for the following general purposes: to customize the advertising and content you see, fulfill your requests for products and services, improve our services, contact you, conduct research, and provide anonymous reporting for internal purposes.
uBurg automatically receives and records information from your computer and browser, including your IP address, uBurg cookie information, software and hardware attributes, and the page you request.

Member Account Security

Once you set an account with uBurg, you will receive a password and account designation upon completing the service's registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to immediately notify uBurg of any unauthorized use of your password or account or any other breach of security, and ensure that you exit from your account at the end of each session. uBurg cannot and will not be liable for any loss or damage arising from your failure to comply with uBurg’s account rules.

Termination

You agree and understand that uBurg without prior notice may terminate your uBurg account and access to the service. Termination shall be made in uBurg's sole discretion and uBurg is not liable to you or any third party for any termination of your account or access to the service.

Disclaimer of Warranties

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS. UBURG AND ITS SUBSIDIARIES, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT UBURG AND, AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF UBURG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE

Trademark Information

All trademarks, service marks, trade names, domain names, slogans, logos, and other indicia of origin that appear on or in connection with the service are the property of uBurg. and/or its partners, parents, subsidiaries, agents, affiliates, and/or licensors. You may not copy, display or use any of these marks without prior written permission of uBurg

Copyright Information

uBurg Corp respects the intellectual property rights of others, and it expects you to do the same. If you know of or suspect that any use of the service constitutes copyright infringement, please send a notice to customer service at uBurg to customer service representative by email at: help@uburg.com.
If uBurg. (a) receives a notice alleging that you have engaged in infringing behavior or (b) reasonably suspects that your use of the service violates uBurg's or others' intellectual property rights, uBurg may, in its sole discretion, suspend or terminate your account with or without notice to you. If uBurg suspends or terminates your user account, it shall have no liability or responsibility to you.
